И это, вроде, вполне относится к невидии с блобом. Нюанс -- "линкует"-то (в смысле запускает) пользователь, не Debian и не Ubuntu. У этих проблема с распространением нелицензионных combined works:
"Until Oracle takes an action like that, it remains a license violation of both CDDLv1 and GPLv2 to distribute binary works that combine together and/or derive from both GPLv2 and CDDLv1 sources."
- и запуск оного пользователем они вовсе не обсуждают. Варез же.
С другой стороны...
...чуть ниже наблюдаем:

- что [как бы] подразумевает, что распространять отдельно и собирать нелицензионные бинарники "пользователем" -- можно и инновационно. Возможно, я посчитал и это относящимся к случаю невидии. И да "их клиенты" Debian оставили в архиве невидиа dkms- сборщик и бинаре-доунлоадер (Уж не знаю отдельные это сущности или один костыль на другом...
